добровольная ликвидация под наблюдением кредиторов
Ликвидация компании на основании особой резолюции, принятой ее членами, в связи с неплатежеспособностью. В течение 14 дней со времени принятия резолюции должно состояться собрание кредиторов (meeting of creditors), о котором кредиторов следует уведомить не позднее чем за семь дней. Уведомления должны быть также направлены в газету “London Gazette” и в две местных газеты. Кредиторы имеют право получить требуемую им информацию до собрания. Ликвидатор (liquidator) компании может быть назначен акционерами компании до того, как состоится собрание кредиторов, либо на собрании кредиторов. Если были назначены два ликвидатора, для решения вопроса можно обратиться в суд.
